This application has been filed seeking to condone the delay of 130 days in filing the written statement.

2.In the affidavit it had been stated that the written statement should have been filed on or before 18.11.2022. It had been stated that in view of the Covid - 19 Pandemic and owing to duties relating to the Church activities, the deponent was not able to give necessary instructions within a stipulated time. There has been delay and it is sought that the delay should be condoned.

3.Heard the learned counsel for the respondents also. 4.The written statement has been filed along with the counter claim. It would only be appropriate that parties given an opportunity to raise all possible pleadings in any civil litigation. Viewed from that angle, this Application is allowed and I would condone the delay and take the written statement and counter claim on record.
