RESPONDENTS Writ petition is filed under Article 226 of the Constitution of India praying for a writ of mandamus to direct the respondents to include the name of the petitioner in the panel as on 1.5.1995 for promotion as Senior Inspector of Co-operative Societies and promote the petitioner in accordance with his seniority with all consequential service and monetary benefits.

With the consent of the learned counsel appearing on either side, the Writ Petition is taken up for final disposal at the admission stage itself.

2.The grievance of the petitioner is that he was denied promotion to the post of Senior Inspector of Co-operative Societies, on the ground that a criminal case was pending against him. 3.It is now stated that the said criminal case ended in acquittal. Hence, the petitioner has filed this Petition to direct the respondents to include his name in the panel as on 1.5.1995 for promotion as Senior Inspector of Co-operative Societies and to promote him from the date on which his junior was promoted. https://hcservices.ecourts.gov.in/hcservices/

4.The learned counsel for the petitioner submitted that the petitioner would be satisfied if a permission is granted to the Petitioner to make a representation to the first respondent setting out the aforesaid facts and prayed for a direction to the first respondent to consider and pass orders of the said representation, within a stipulated time.

5.In view of the narrow prayer made, the petitioner is permitted to make a representation to the first respondent, setting out his grievance and on receipt of the said representation, the first respondent is directed to pass orders on the representation, on merits and in accordance with law, within a period of twelve weeks from the date of receipt of the representation.
