It is seen that the petitioner has entered into a Construction Agreement with the defacto Complainant dated 19.02.2014 wherein in Para 16 the petitioner has agreed to complete the construction within 18 months from the date of getting approval. This means that the defacto complainant knew that approval was not obtained at the time of entering into the construction agreement. It appears to be contract in nature.
