Respondents Petition filed under Article 226 of the Constitution of India praying for issue of Writ of Mandamus to direct the 2nd respondent to cancel the patta which is issued in favour of 4, 5 & 6th respondents in water course poramboke land comprising in S.No.295B/1D, 295B/1C, 295/1D, 295 & 288, 289, 290, 292/2, 296C, 296A & 67B/1 situated at Kavanur Village and Anaimallur Village, Arcot Taluk, Vellore District and thereby to remove the encroachment in the above Survey Numbers in order to safeguard the water course area based on the petitioner representation dated 19.02.2019, within a stipulated time as fixed by this Court.

O R D E R

The learned counsel for the petitioner seeks permission to withdraw the writ petition with liberty to approach the Appellate Authority under Section 12 of the Tamil Nadu Patta Passbook Act, 1983, seeking for cancellation of patta issued in favour of respondent nos.4 to 6. The learned counsel has also made an endorsement to the said effect.

In view of the same, the writ petition is dismissed as withdrawn, giving liberty to the petitioner to approach the Appellate Authority, under Section 12 of the Tamil Nadu Patta Passbook Act, 1983, seeking for cancellation of patta issued in favour of respondent nos.4 to 6. No costs.
