Radha Lime Stone Mines v. The State Of Tamilnadu
W.M.P.No.17346 of 2022 & W.P.No.38096 of 2005 N. SATHISH KUMAR, J.
This petition has been filed to restore the Writ Petition in W.P.No.38096 of 2005 which was dismissed as withdrawn on 20.06.2019 and dispose of the Writ petition on merits.
2. It is the contention of the learned counsel appearing for the petitioner, that instead of withdrawing the connected Writ Petition which has become infructuous, he has wrongly made an endorsement in this writ petition and hence, this petition has been dismissed as withdrawn. As directed by this he has filed a better affidavit and due to default of the counsel, the party should not suffer, he is willing to pay a cost of Rs.25,000/- to the Legal Services Authority.
3. In view of the above submissions and taking note of the better affidavit filed by the learned counsel appearing for the petitioner, the Writ Petition in W.P.No.38096 of 2005 is restored subject to the condition on payment of cost of Rs.25,000/- [Rupees Twenty five thousand only] to the Tamilnadu Legal Services Authority, High Court, Chennai, on or before 19.09.2022. https://www.mhc.tn.gov.in/judis
