ORDER

This petition to quash the complaint pending in C.C.No.868 of 2023 on the file of the Judicial Magistrate Court No.II, Alandur, for the alleged offence under Sections 294(b), 324 and 506(i) of IPC.

2. The learned counsel appearing for the petitioner submitted that it is a trivial dispute between the neighbours regarding parking of the car, which has not been exhausted leading to filing of the final report.

3. However, on reading of the complaint, statement and wound certificate, this Court finds that the petitioner has attacked the son of the defacto complainant with stone when he asked to move the car which was blocking the way of the defacto complainant's house. Since there is substance prima facie for framing charge and conducting the trial, the Criminal Original Petition is liable to be dismissed. 2/4

4. Accordingly, this Criminal Original Petition is dismissed. Consequently, connected Miscellaneous Petitions are closed. 08.04.2024 Index:yes/no ari To:
