This Writ Petition is filed for a Mandamus directing the respondent to consider the reopen petition filed along with urgent application with all

appropriate documents bearing e-office number:2430029 seeking to reopen the enquiry in R.P.No.374 of 2025 and enable him to participate in the enquiry proceedings.

The case of the petitioner is that he filed an application in O.A.No.1 of 2025 before the Joint Commissioner, Erode, seeking to declare the office of Trusteeship of Arulmighu Maasi Vaan Karuppuswamy Temple situated at Kollimalai Taluk, Namakkal District as hereditary and the office of the trusteeship held by him as hereditary as laid down under section 63(b) of the Tamil Nadu HRand CE Act. During the pendency of the said application, one M.Chella Kutty and 13 others filed I.A.No.24 of 2025 seeking to implead themselves as respondents in O.A.No.1 of 2015. The said application was dismissed on full fledged enquiry by the Joint Commissioner on 04.09.2025. Aggrieved by the same, R.P.No.374 of 2025 was filed by the aforesaid Chella Kutty and 13 others, however, the said case was adjourned without any specific date for next hearing.

When the counsel representing the petitioner was about to file vakalat, it was informed that the matter was already reserved for orders and vakalat could not be entertained. Therefore, the petitioner immediately filed a petition seeking to reopen the enquiry of revision petition in RP.No.374 of 2025 and afford opportunity to take part in the said enquiry. However, the respondent has returned the said petition, against which the petitioner has filed the instant writ petition.

3. Heard the learned counsel for the parties and perused the materials on record.

Considering the limited scope of prayer, this Court, without expressing anything on merits, directs the respondent to consider the reopen petition filed by the petitioner along with urgent application and all appropriate documents bearing e-office No.2430029 seeking to reopen the enquiry in R.P.No.374 of 2025 and pass appropriate orders on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.

5. Accordingly, this Writ Petition stands disposed of with the above direction. No costs.
