Respondents PRAYER: This writ petition is filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the 1st respondent, herein to take appropriate recovery proceedings against the respondents 2 to 4 based on the petitioner's representation dated 17.11.2020. O R D E R

This writ petition has been filed, directing the 1st respondent, herein to take appropriate recovery proceedings against the respondents 2 to 4 based on the petitioner's representation dated 17.11.2020.

2. The case of the petitioner is that the petitioner is a victim in the motor accident which took place on 16.11.2012. He filed a claim petition in MCOP No.1744 of 2012 on the file of the Motor Accident Claims Tribunal cum Principal District Judge, Dharmapuri, seeking for compensation for the injuries sustained by him and the Tribunal passed an order dated 18.03.2016, awarding the total compensation of Rs.5,85,400/- with interest at the rate of 7.5% per annum from the date of petition. However, till date, the respondents has not deposited the award amount into the Tribunal. Therefore, the petitioner made a representation to the 1st respondent dated 17.11.2020 to take appropriate action under the Revenue Recovery Act. But, no action was taken till date. Hence, the present writ petition is filed with the above said prayer.

3. However, the learned counsel for the petitioner would submit that already, the petitioner has filed an execution petition in MCOP No.1744 of 2012 on the file of the Motor Accident Claims Tribunal cum Principal District

Judge, Dharmapuri and this Court may grant liberty to the petitioner to work out his remedy before the Tribunal in the manner known to law.

4. In view of the above, this writ petition is disposed of with liberty to the petitioner to work out his remedy before the Motor Accident Claims Tribunal cum Principal District Judge, Dharmapuri, in the manner known to law. No costs.
