O R D E R
The petitioner who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 294(b), 323, 307 and 506(ii) of IPC, in Crime No.1072 of 2020, seeks anticipatory bail.
2. The case of the prosecution is that the de-facto complainant along with this petitioner and others went to consume liquor, at that time, there was a wordy quarrel between the de-facto complainant's son and the accused persons, as a result of which, the petitioner along with others had attacked the de-facto complainant's son and caused injuries. Hence, the complaint was registered.
3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. Therefore, he prays to grant anticipatory bail to the petitioner.
4. The learned Additional Public Prosecutor would submit that the de-facto complainant along with this petitioner and others went to consume liquor, at that time, there was a wordy quarrel between the de-facto complainant's son and the accused persons, as a result of which, the petitioner along with others had attacked the de-facto complainant's son and caused injuries. the victim is still in hospital. Hence he vehemently opposed to grant anticipatory bail to the petitioner.
5. Considering the above fact and circumstances of the case and also the fact that the victim is still in hospital and there are two previous cases pending as against the petitioner. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.
