IN THE HIGH COURT OF JUDICATURE AT MADRAS

( Criminal Jurisdiction ) Wednesday, the Twenty Seventh day of April Two Thousand Twenty Two PRESENT The Hon`ble Dr Justice G. JAYACHANDRAN CRIMINAL ORIGINAL PETITION No.9641 of 2022 PREM [ PETITIONER / ACCUSED ] Vs UNION TERRITORY OF PUDUCHERRY REP BY [ RESPONDENT ] THE STATION HOUSE OF OFFICER (SHO), VILLIANUR POLICE STATION, PUDUCHERRY.

CR.NO.117/2022.

For Petitioner : M/S.PRAKASHADIAPADAM Advocate For Respondent : MR.V.BALAMURUGANE, Additional Public Prosecutor for Puducherry, PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner herein, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 294(b), 323, & 506(ii) of IPC r/w 34 of IPC, in Crime No.117 of 2022, on the file of the respondent police, seeks anticipatory bail.

2. Heard the learned counsel for the petitioner.

3. According to the First Information Report the de facto complainant Ramachandiran went to the house of the petitioner to question about the conduct of the petitioner, who was harassing his relative 15 years old girl. The said Ramachandiran was attacked by this petitioner and his family members. Hence a case has been registered on 17.04.2022 by the respondent police in Crime No.117 of 2022.

4. Grant of anticipatory bail is opposed by the learned Public Prosecutor (Puducherry) on the ground that this petitioner on coming to know about the case registered against him, pursuant to the https://hcservices.ecourts.gov.in/hcservices/

complaint given by the Ramachandiran had gone to the house of the Rithika and threatened them to withdraw the complaint. When they did not hail the early hours of 18.00, this petitioner along with another persons had gone to the house of the Ramachandiran and set the twowheeler on fire. Hence another complaint is also registered against this petitioner stating that if the petitioner is enlarged on bail there is a possibility of causing threat to the de facto complainant and his family members.

4. The learned counsel for the petitioner in turn would submit that the said petitioner is in love with the girl Rithika and to severe the relationship he has been threatened by the de facto complainant and the family members.

5. Considering the fact that the girl Rithika is hardly 15 years and this petitioner appears to have been sexually harassing her and also attacked the family members, who have questioned his conduct, and not speaking with them, he and his associates have gone to the house of the de facto complainant and set the two-wheeler fire. The conduct of the petitioner indicates that if he is at liberty there will be constant threat to the life of the minor girl as well as her family members.

6. Hence, this Criminal Original Petition is dismissed. -sd/- 27/04/2022 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.) High Court, Madras - 600 104.
