CMP.No.19977 of 2019 in CMA (SR) No.45675 of 2019 R.MAHADEVAN, J.

This petition is filed by the petitioners / appellants / claimants seeking to condone the delay of 2174 days in filing the above Appeal.

2. Heard both sides. The learned counsel for R-2/Insurance Company stated No Objection in ordering this petition. Despite serving notice on the first respondent and his name printed in the cause-list, there is no representation on behalf of him.

3. In view of the said submission, having regard to the reasons stated in the accompanying affidavit filed in support of this petition and being satisfied with the same, the delay of 2174 days in filing the above Appeal is condoned subject to the following conditions:- (i) The petitioner / appellant shall pay a sum of Rs.2000/- as costs to the "Tamil Nadu State Legal Services Authority, Chennai" on or before 06.12.2019 failing which this application shall stand dismissed automatically without further reference to this Court.

(ii) The petitioner / appellant / claimant is not entitled to any interest for the default period, in the event of succeeding in the Appeal.

4. This petition is ordered accordingly.
