ORDER
This writ petition is filed to call for the records pertaining to the impugned order dated 31.07.2023.
2. Upon perusing the affidavit filed in support of the writ petition and the material records of the case and upon hearing, Mr.S.Balamurugan, the learned Government Advocate appearing on behalf of the first respondent and Mr.S.Madhusudhanan, the learned counsel appearing on behalf of the second to sixth respondents, the grievance of the petitioner is that when the petitioner made an application to shift the electric line, the same was approved and steps 2/5
were taken and five poles were erected. However, in respect of the sixth pole, the seventh respondent claimed that the place where the sixth pole is being erected belongs to her. Therefore, the request was made to the jurisdictional surveyor to survey the land. The same was not completed and as such, the impugned communication was issued.
3. As a matter of fact, the petitioner could have followed up on the survey application and the survey could have been completed. Be that as it may, now, in view of the limited relief that is being granted, this writ petition is disposed of the admission stage without notice to the seventh respondent.
4. The Tahsildar, Vaniyambadi taluk, Tirupattur District, shall cause the jurisdictional firka surveyor to survey the field, as requested by the fifth and sixth respondents in the presence of both the petitioner as well as the seventh respondent. It will be open for the seventh respondent to submit her objections during the survey and the same shall be expressly considered. The survey report shall be furnished both to the authorities and the parties and thereafter further proceedings can be undertaken depending on the outcome of the survey report. The said exercise shall be completed within a period of eight weeks from the date or receipt of web copy of the order without waiting for the 3/5
certified copy of the order.
5. In view thereof, this writ petition is disposed of. Consequently, connected miscellaneous petition is closed. No costs. 01.04.2025 nsl To 1.
