L.Lakshmanan v. The Presiding Officer
W.A. Nos.391 to 396 of 2018 W.A. Nos.391 to 396 of 2018 S. VAIDYANATHAN, J.
and K. RAJASEKAR, J.
This Court, vide common judgment dated 11.07.2023, dismissed these writ appeals with a direction to the Labour Court, Salem, to decide the industrial disputes being I.D. Nos.132 to 137 of 2008 before the end of the last year and the operative portion of the said common judgment reads thus: "7 While confirming the common order passed by the Single Bench, affirming the orders passed by the first respondent Labour Court in the interlocutory applications, we hold that the industrial disputes stand restored on file and we expect the Labour Court to decide the industrial disputes as expeditiously as possible, preferably before this year end, without adjourning the matter beyond a period of 7 working days at any point of time. The parties are expected to appear before the first respondent Labour Court on 01.08.2023."
Now, the Presiding Officer of the Labour Court, Salem, has sought six months' time to decide the industrial disputes, on the ground that his predecessor-in-office was transferred and he assumed full additional charge as the Presiding Officer of the Labour Court, Salem, only on 22.08.2023 and soon after assuming charge, he had availed leave from 26.08.2023 to 07.09.2023. Yet another reason assigned by him is that he looks after the regular work of the I Additional District Court, Salem, too.
Satisfied with the aforesaid reasons assigned, time is granted to the Presiding Officer, Labour Court, Salem, till 31.07.2024 for deciding I.D. Nos.132 to 137 of 2008.
