Writ Petition filed under Article 226 of the Constitution of India for issuing a Writ of Mandamus directing the respondents to shift the E.B. Line from the petitioner's land to the road side pillars.

O R D E R

The petitioner has filed the above Writ Petition to issue a Writ of Mandamus directing the respondents to shift the electricity line from the petitioner's land to the road side pillars.

2. Mr. N.P. Kumar, learned counsel appearing for the petitioner submitted that instead of deciding the prayer sought for in the Writ Petition, it would be suffice to give liberty to the petitioner to given an application to the 4th respondent for shifting of the Electricity line and in the event of the petitioner giving such an application, the 4th respondent may be directed to pass orders on the same on merits and in accordance with law.

3. Mr. M. Varun Kumar, learned Standing Counsel appearing for the respondents submitted that in the event of the petitioner giving an application to the 4th respondent for shifting of the electricity line, the same would be considered on merits and in accordance with law.

4. Having regard to the submissions made by the learned counsel on either side, I give liberty to the petitioner to give an application seeking for shifting of the electricity line to the 4th respondent and on submission of the application, the 4th respondent is directed to consider the same and pass orders on merits and in accordance with law, as expeditiously as possible.

With these observations, the Writ Petition is disposed of. No costs.
