Today (20.10.2017) , when the matter is taken up for hearing, the learned counsel for the appellant submitted that the sole appellant has died in the year 2011 itself and there is no instructions from his legal heirs. Hence, this Civil Miscellaneous Appeal may be dismissed as infructuous. He has also made an endorsement to that effect.
