This case is taken up for settlement before the National Lok Adalat. Both the parties are present. Mr.R.Mariappan, learned counsel for petitioner and Mrs.Aswini Devi, learned Standing Counsel for respondents 1 and 2 and Mr.Udaya Balu, learned Standing Counsel for the third respondent are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:

TERMS OF SETTLEMENT The writ petitioner challenges the notice issued by the Greater Chennai Corporation. The petitioner also seeks for mutation of revenue

records in the name of the petitioner, who is the one of the legal heirs of the original owner, G.R.Ramasubramaniam.

2.Today, the petitioner along with the learned counsel for the petitioner are present. The officials of the Greater Chennai Corporation and their counsel are also present.

3.After deliberation, the parties have agreed that the Corporation officials shall carry out and inspection and measure the building of the petition property and explore the possibilities of reducing the tax payable by the petitioner. Insofar as the name change, the parties have agreed that the petitioner shall produce no objection/consent affidavit from the surviving legal heirs of G.R.Ramasubramaniam, viz., two sisters. On such production of the non-objection certificates, the Corporation shall effect mutation in the name of the writ petitioner and issue fresh assessment notice in the name of the petitioner. Based on the mutation, the writ petitioner shall not claim any absolute right over the property. The officials of the Chennai Metropolitan Water Supply and Sewarage Board are present and they have also agreed to revise the assessment, subject to the final revision being made by the Corporation.

4.In view of the above, no further orders are required to be passed in the writ petition. The writ petition stands disposed of. The petitioner also undertakes to pay the revised amount to be arrived at. No costs. Connected Civil Miscellaneous Petitions are closed. This Lok Adalat award is passed in terms of the above settlement. The full Court fee paid shall be refunded to the appellant in the manner provided under Section 69-A of the Tamil Nadu Court-Fees and Suits Valuation Act, 1955 and the Court Fees Act, 1870 as provided for under sub Sec.1 of Section 21 r/w 25 of LSA Act 1987 as amended in 1994.
