C.M.P.No.17058 of 2016 in C.M.A (SR).No.44607 of 2016 M.Jaichandren, J., and T.Mathivanan, J., (Order of the Court was made by M.JAICHANDREN, J., ) This miscellaneous petition has been filed seeking to condone the delay of 58 days in filing the appeal, in C.M.A. (SR) No.44607 of 2016.

2. The reasons for the delay in filing the appeal have been stated in the affidavit filed in support of the petition.

3. The notice directed to be issued by this Court, by its order, dated 26.10.2016, had been served on the sole respondent, on 19.11.2016. Based on the order passed by this Court, on 26.10.2016, the said notice had been served on V.Ganesh, who is the next friend, representing Mrs.Kaveramma, who is said to be mentally retarded.

4. Pursuant to the service of the Court notice, the name of Kaveramma has been printed in the cause list. However, there is no representation on behalf of the said respondent.

5. For the reasons stated in the affidavit filed in support of the Civil Miscellaneous Petition, we find it appropriate to condone the delay of 58 days in filing the Civil Miscellaneous Appeal. Accordingly, the delay is condoned and this Civil Miscellaneous Petition stands allowed. Registry is directed to number the Civil Miscellaneous Appeal and list the same for admission.
