Vs 1 M.A.HARI VIKNESH [ RESPONDENTS ] 2 A.SAKTHIVEL Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to grant stay of execution of the decree dated 26.06.2020 made in MCOP No.2362 of 2016 on the file of the Motor Accidents Claims Tribunal (Special Sub Court No.1), Salem [IN CMP No.10605/2021] pending disposal of the above CMA.NO.1965/2021.

Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.D.BHASKARAN, Advocate for the petitioner and of M/S.S.SIVA KUMAR, Advocate for the Respondents, the court made the following order:- [Order of the Court was made by M.M.SUNDRESH, J.] Mr.S.Siva Kumar, learned counsel takes notice for the first respondent.

There shall be an order of interim stay on condition that the petitioner/Insurance Company deposits 50% of the compensation awarded by the Tribunal along with the interest to the credit of M.C.O.P.No.2362 of 2016 on the file of Motor Accident Claims Tribunal (Special Sub-Court No.1,) Salem within a period of four weeks from the date of receipt of a copy this order. https://hcservices.ecourts.gov.in/hcservices/

On such deposit, the first respondent/claimant is permitted to withdraw 50% of the amount deposited.
