` Challenge has been made to the order of attachment dated 25.02.2025 passed by the trial Court/ IX Assistant City Civil Judge, Chennai, in E.P No.3691 of 2023 in Arb. O.P (Common Div) No.79 of 2.The Execution Petition has been laid for a sum of Rs.86,17,530/-, that apart, Rs.2,00,000/- for litigation expenses. 2/4
3. Mr.D.Ravichander, learned Special Government Pleader would submit that a sum of Rs.86,17,530/- has been fully deposited before the Executing Court which has not been disputed by the respondent.
4. In such view of the matter, as the dispute is only with regard to the litigation charges, the parties may negotiate the same and settle the issue.
5. Accordingly, the attachment order passed by the trial Court is raised and the respondent is permitted to withdraw the amount deposited by the petitioner. It is open to the parties to negotiate for Rs.2,00,000/- towards litigation expenses and also future interest, in the pending Execution Petition. Attachment order dated 25.02.2025 passed by the trial Court/XI Assistant Judge, City Civil Court, Chennai, is set aside. Therefore, Execution Petition is closed for the present. In the event, any negotiations are not fructified, the respondent is at liberty to file a fresh Execution Petition for that amount alone. 3/4
