Writ Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus directing the respondents to consider the representation dated 26.06.2020 of the petitioner seeking transfer from Indian Overseas Bank Branch located at nearby his home I.e., Avadi Branch or Pattabiram/Tirunintravur Branch as early as possible within time limit that may be fixed by this Court.

The matter is taken up through web hearing.
2.This writ petition is filed for the following prayer: "To direct the respondents to consider the representation dated 26.06.2020 of the petitioner seeking transfer from Indian Overseas Bank Branch located at nearby his home I.e., Avadi Branch or
Pattabiram/Tirunintravur Branch as early as possible within time limit that may be fixed by this Court." 3.The petitioner is an employee of the respondent/Bank and he is presently working in Muthialpet Branch, Chennai. According to him, that he has completed 7 years of service in the same branch. He has 2 more years left for his retirement. The petitioner has also stated that he is suffering from various ailments like Blood Pressure, back pain etc.
4.According to the petitioner that he is finding it extremely difficult to commute from his residence in Avadi to the branch at Muthialpet. Therefore, he has submitted applications recently for transfer to any other branches located near his residence at Avadi or Pattabiram or Tirunintravur area. 5.Notice was ordered in the writ petition and Mr.Srinivasa Murthy appeared on behalf of Mr.N.G.R.Prasad, learned counsel for respondents.
6.This Court enquired with learned counsel appearing for the Bank, whether it is possible to accede to the request of the petitioner. On instructions, Mr.Srinivasa Murthy, learned Counsel would submit that in the cadre of petitioner, there are no vacancies available right now in the places where the petitioner is requesting for his transfer.
7.At this, the learned counsel for the petitioner would submit that many similar requests have been considered and the Bank has accommodated their interests but unfortunately for the petitioner alone, the Bank is not inclined to consider his case sympathetically. He would submit that a direction may be atleast issued to the Bank to consider his recent request made on-line and transfer him to any existing vacancy or any immediately arising future vacancy, in the places of his choice. 8.
In consideration of the above submission, and also on consideration that the petitioner has only 2 years left for his superannuation, the writ petition is disposed of as under: "the respondents are directed to consider the latest request of the petitioner stated to have been made through on-line and post him in any existing vacancies at Avadi, Pattabiram or Tirunintravur or any other nearby place, if the vacancies are not available now, consider him posting in any immediately arising vacancy. The respondents are directed to take a decision by considering the request sympathetically either now or in future depending on the availability of vacancies."
Therefore, the writ petition stands disposed of. No costs. Consequently, the connected miscellaneous petitions are closed.
