O R D E R
The petitioner has come forward with this Civil Revision Petition seeking earlier disposal of I.A.No.761 of 2014 in O.P.No.4831 of 2013, filed under Section 24 of the Hindu Marriage Act, 1955, seeking interim maintenance of Rs.15,000/- to the petitioner and her child and a litigation expenses of Rs.25,000/-, within a time stipulated by this Court.
2. At the time of admission, arguments of learned counsel for
the petitioner was heard in length. Considering the nature of order to be passed, notice to respondent is dispensed with.
3. The respondent herein/husband filed petition in O.P.No.4831/2013 for restoration of conjugal rights against the petitioner/wife, stating that wife deserted him for the past 6 months. During the pendency of the above O.P.No.4831 of 2013, the wife filed petition under Section 24 of the Hindu Marriage Act, 1955 seeking interim maintenance and litigation expenses.
4. According to the learned counsel for the petitioner herein/wife, even though the I.A., was numbered, the said petition was not disposed of and the matter has been adjourned for several hearings for filing counter by the respondent/husband. The learned counsel thus prayed for stipulating a time limit to the trial court for disposal of the said I.A..
5. Considering the limited prayer sought in this Civil Revision Petition, the III Additional Family Court Judge, Chennai is directed to dispose of I.A.No.761 of 2014 in O.P.No.4831 of 2013 within a period of 30 days from the date of receipt of a copy of this order.
6. This Civil Revision Petition is disposed of with the above direction. No costs.
