These three petitions have been filed by the petitioners/proposed appellants, i) to condone the delay of 5365 days in filing the petition to set aside the abatement caused due to the death of the sole appellant, namely M.Natarajan, in the above appeal, ii) to set aside the abatement caused due to the death of M.Natarajan, the sole appellant and iii) to bring on record the legal heirs of the deceased M.Natarajan, the sole appellant, as appellants 2 to 4 in the above CMA.

2. The learned Government Advocate, Pondicherry appearing for the respondents 1 to 5 has no objection in allowing these three petitions. 3.Being satisfied with the reasons stated in the affidavits filed in support of these petitions and subject to the interest being waived off for the period of delay of 5365 days, the delay is condoned and all the three petitions are allowed.

4. Registry is directed to carry out necessary amendment and post the main appeal on 11.04.2023.
