ORDER : The Court Made the following order :- The petitioner herein, who was arrested on 25.03.2022 for the alleged offence under Sections 406, 420, 468, 471 of IPC read with Section 34 of IPC in Crime No.242 of 2021, seeks bail.

2. Heard the learned counsel for the petitioner.

3. It is a case of cheating by fabricating the documents. The defacto complainant herein has given a complaint against this petitioner and others alleging that the petitioner along with others have sold two plots to him and received Rs.61,49,000/- and on verification, the documents produced by them found to be fabricated document and patta , CMDA approval given by them are fake documents.

4. The learned Additional Public Prosecutor for the respondent states that originally the property belongs to the father of this petitioner. During the life of his father, the property was sold through realtor. After alienating the property, by plotting the land into 119 plots, subsequently identifying the unoccupied plots, documents were fabricated as if settlement deed was executed in favour of the petitioner and his brothers and through realtor by name M/s.R.J.Housing Property Private Limited, the plots were sold creating fake documents like patta and CMDA approval. https://hcservices.ecourts.gov.in/hcservices/

5. The investigation has revealed that the title documents presented for transfer of plot Nos.106, 109 and 111 are not in existence. The other persons, who are the brother of the petitioner are still absconding and the investigation is at very crucial stage. Hence, grant of bail to the petitioner is not conducive for the investigation. Hence, this Criminal Original Petition for bail is dismissed for the present.
