This writ petition is filed under Article 226 of the Constitution of India, seeking writ of certiorarified mandamus, calling for the records relating to the impugned charge memo issued by the 3rd respondent in Na.Ka.No.2545/ 2023/K2 (2/2) dated 22.08.2023 and quash the same and Consequently to direct the 2nd respondent to consider the name of the

petitioner for promotion as Assistant Executive Engineer in the panel 2025 - 26 on par with his Junior Thiru.K.Chandrasekaran, who has been promoted as Assistant Executive Engineer on 26.02.2026 with all service and monetary benefits, within a reasonable period as may be fixed by this Court.

ORDER

This writ petition is filed for the following relief: "To call for the records relating to the impugned charge memo issued by the 3rd respondent in Na.Ka.No.2545/ 2023/K2 (2/2) dated 22.08.2023 and quash the same and Consequently to direct the 2nd respondent to consider the name of the petitioner for promotion as Assistant Executive Engineer in the panel 2025 - 26 on par with his Junior Thiru.K.Chandrasekaran, who has been promoted as Assistant Executive Engineer on 26.02.2026 with all service and monetary benefits, within a reasonable period as may be fixed by this Court."

2. The case of the petitioner is that he was originally appointed as Assistant Engineer in the Rural Development Department in the year 2009 by the Tamil Nadu Public Service Commission. During his service at Thekkampatti Panchayat Union, the petitioner has done a construction work of overhead water tank under Jal Jeevan Mission in 2021 - 2022 in Thekkampatti Panchayat Union, Karamadai, Coimbatore District. The petitioner would submit that on a misconception, the District Collector, Coimbatore has issued a charge memo after a period of 3 years. Challenging the same, the petitioner is before this Court.

3. The learned counsel for the petitioner would submit that the charge memo was issued after a period of 3 years and no final order has been passed for the last 2 years. Further, the charge memo is defective and does not contain Annexure IV, the list of witnesses. The learned counsel would further submit that the enquiry has been completed and the petitioner has also submitted his explanation to the same. However, orders have not been passed.

4. Considering the fact that the enquiry report is filed and the petitioner has also submitted his explanation to the same, this writ petition is disposed of with a direction to the 1st respondent to pass orders within a period of 4 weeks from the date of receipt of a copy of this order.
