2. The learned counsel for the respondent has no serious objections for condoning the delay subject to payment of cost.

3. Having regard to the fact that the respondent no objection for condoning the delay and nature of reasons set out in the affidavit, this Court is of the view that in order to give a fair opportunity to file the Written Statement, the delay is condoned subject to the payment of cost of Rs.5000/- payable to the plaintiff on or before 09.01.2017.
