The relief sought for in the present writ petition is to direct the first respondent herein to dispose of the petitioner's representation dated 05.01.2024 and to re-consider the resolution passed in 21st equivalence committee meeting and declare that Master of Business Administration is an equivalent degree and permit the petitioner to join in M.Phil Development Economics Course in second respondent/university. Admittedly, the petitioner submitted an application seeking admission for M.Phil Development Economics Course in University of Madras. The petitioner has completed Master of Business Administration. The petitioner submitted an application for grant of Equivalence Certificate. The Tamil Nadu State Counsel for Higher Education issued a Letter dated 25.09.2023, stating that Master of Business Administration Degree awarded by the University of Madras is not equivalent to M.A. Economics for the purpose of Higher Studies. The said communication was sent based on the resolution passed by the Equivalence Committee. The Equivalence Committee Page No.2 of 5
is an expert body competent to declare the equivalence between the various degrees awarded by the Universities across the country. The Equivalence Committee has passed resolutions stating that Master of Business Administration awarded by the University of Madras is not equivalent to M.A. Economics for the purpose of higher studies. Therefore, the case of the petitioner for admission to M.Phil Development Economics Course was not considered.

Mr.M.Rajkumar, learned Counsel for the petitioner would submit that a direction may be issued to consider the representation. 4.
Such a direction would do no service to the cause of Justice. The person approaching the High Court has to establish his right at the first instance and in the absence of establishing any right, the writ petition is not entertainable. In the present case, the petitioner is not eligible for admission to M.Phil Development Economics Course, since she is not possessing the qualification of M.A. Economics and she is possessing a degree in Master of Business Administration. Therefore, the petitioner has not established any right.

Accordingly, the Writ Petition stands dismissed at the admission stage itself. No costs.
