Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents to consider the petitioner's representation dated 18.01.2024 and consequently direct the second respondent to comply the letter of communication sent by the first respondent vide his office proceedings No.M0.MU[B1] 3044/2023 dated 31.08.2023.

ORDER

With the consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

2. This writ petition is filed to direct the respondents to consider the representation of the petitioner dated 18.01.2024 and consequently direct the second respondent to comply the communication sent by the first respondent vide his office proceedings No.M0.MU[B1] 3044/2023 dated 31.08.2023.

3. Heard learned counsel for the petitioner and the learned Government Advocate appearing for the respondents and perused the materials available on record.

4. In an earlier occasion the petitioner has filed a Writ Petition in W.P.No.19219 of 2023 for the same relief and this Court by an Order dated 28.06.2023 directed the first respondent therein to consider the representation of the petitioner and pass Order in accordance with law. Pursuant to the Order of this Court, the Revenue Divisional Officer has passed an Order recording a finding that the dead body has to be buried in Kowsiya Nagar and herein after no dead bodies will be allowed to be buried in the locality where people reside 2/4

and the burial has to be done in Survey No.499. Since Orders has already been passed by the Revenue Divisional Officer to bury the dead bodies 90 meters far from the residential areas, at this stage, this Court is of the view that no further Orders is required in this Writ Petition.
