ORDER

This Criminal Original Petition has been filed praying to direct the Judicial Magistrate, Sirkali to complete the committal proceedings in PRC No.45/2015 in a time bound manner and conclude the trial within a time frame.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

3. It is seen that this petitioner is a defacto-complainant and he has been cited as a eye-witness in the final report, that has been filed by the respondent Police in PRC.No.45 of 2015. The petitioner is fearing safety to his life, in view of the antecedants of the accused in this case and therefore he apprehends that, he may be liquidated even before he gets into the witness box before the Sessions Court.

4. The learned Additional Public Prosecutor submits that the learned Committal Magistrate has issued summons to the accused for their appearance on 05.09.2015.

5. Taking into consideration, the facts and circumstances of the case, this Court directs the learned Judicial Magistrate, Sirkali to expeditiously conduct the committal proceedings and send the case papers to the Sessions Court, in accordance with law.

6. With the above direction, this Criminal Original Petition is closed.
