2. Heard the learned counsel for the petitioner and the learned counsel for the respondent and also perused the materials available on record.

3. On being satisfied with the averments stated in the affidavit filed in support of the petition and the submissions made by the learned counsel on either side, the delay is condoned.

4. Registry is directed to number the Appeal Suit, if it is otherwise in order and post the matter on 28.04.2023.
