ORDER
[Order of the Court was made by M.M.SUNDRESH, J.] Seeking a directing to the respondents to produce the body of the detenu Thyaneswaran, Son of C.M.Raghunathan, aged about 22 years, the present Habeas Corpus Petition has been filed by the father of the detenu, inter alia, alleging that he is in the illegal custody of the respondents 4 and 5.
2. Placing reliance upon the status report, the learned Government Advocate (Crl. Side) would submit that the detenu and the fifth respondent have eloped for the third time. To verify the fact, we have also enquired the police officer, who is present. He also reiterated the very same statement made by the learned Government Advocate (Crl. Side).
3. Considering the above, we do not find any illegal detention involved and the Habeas Corpus Petition stands closed. However, efforts should be made to trace the detenu and the fifth respondent. As and when the detenu and the fifth respondent are secured, they should be produced before the jurisdictional Magistrate.
