O R D E R

This criminal original petition is filed seeking a direction to respondents 1 to 3 not to harass the petitioner and his family members on the complaint of respondents 4 and 5. The petitioner and the 4th respondent are brothers and the entire issue arises out of property dispute between them. According to the petitioner, the 4th respondent is interfering with his possession of the land situated at S.No. 119/3, measuring 2.06 acres, Kural Village, Chinnasalem Taluk, Kallakurichi District, thereby disturbing his agricultural activities. According to the petitioner, though his father did not partition the properties or leave any Will behind, the said land is in his 2\6

possession and the 4th respondent is also said to have relinquished his rights over the said land. However, the 4th respondent, with the aid of the 5th respondent is disturbing petitioner's possession of the said land and there are civil suits pending between the parties. Further, it is the case of the petitioner that at the instance of 4th and 5th respondents, the respondent Police is forcing the petitioner to hand over the possession of the land to the 4th respondent. Hence, the present criminal original petition. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for respondents 1 to 3 and perused the materials on record.

It is seen that the petitioner has lodged two complaints on 03.10.2025 and 06.12.2025 and both have been assigned CSR Nos. 658 of 2025 and 788 of 2025 respectively. Pursuant to the same, the petitioner was called for enquiry and it cannot be termed as harassment.

5. Both the CSRs have been enquired and closed finding that there are civil suits pending in O.S. No. 724 of 2025 (instituted by the petitioner) and O.S. No. 177 of 2025 (instituted by the brother of the petitioner) between the parties. The petitioner is no more required for any enquiry. It is 3\6

for the parties to approach the Civil Court and get appropriate injunction to safeguard their civil rights and not to take law into their own hands. If there is any law and order problem, the respondent Police is at liberty to intervene and look into the same.

The criminal original petition stands disposed of with the above observation.
