Mr.J.Purushothaman, learned Government Advocate takes notice for the respondents. By consent of the parties, the main writ petition is taken up for final disposal at the admission stage itself.
2. The petitioner seeks for a mandamus directing the respondents to take steps to grant compensation to the petitioner for the demise of her son Madharasan in the Gaja Cyclone renovation work, based on her representation dated 20.02.2019.
3. It is stated that the petitioner's son namely Madharasan and others were engaged in the work of removing the tress fell over the Vertinary Hospital, situated at Kovilthavu Village, Vedharanyam Taluk, Nagapattinam District, due to Gaja Cyclone hit. It is further stated that on 22.12.2018, the petitioner's son died, while doing the work of removing trees fell due to "Gaja Cyclone". Thereafter, the petitioner approached the 2nd respondent and made a representation dated 20.02.2019, requesting to grant compensation for the death of her son. However, the same has not been considered by the respondents so far. Hence, the petitioner approached this Court and filed the present writ petition seeking for the relief as stated supra.
4. Heard both sides.
5. This Court, at this stage, is not expressing any view on the merits of the claim made by the petitioner, as it is for the 2nd respondent to consider and decide the same on merits and in accordance with law. Thus, this writ petition is disposed of, only with a direction to the 2nd respondent to consider the representation of the petitioner dated 20.02.2019 and pass orders on the same on merits and in accordance with law, after hearing the petitioner and other interested parties, if any. Such exercise shall be done by the 2nd respondent within a period of six weeks from the date of receipt of a copy of this order. No costs.
