Criminal Miscellaneous Petition filed under Section 482 of Criminal Procedure Code, to modify one of the condition to execute a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with one surety of the parent of the petitioner instead of to execute a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties out of which, one surety shall be the parent of the petitioner and the other shall be the solvent surety, each for a like sum in the order passed in Crl.O.P.No31057 of 2019. O R D E R

This petition has been filed by the petitioner to modify one of the condition to execute a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with one surety of the parent of the petitioner instead of to execute a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties out of which, one surety shall be the parent of the petitioner and the other shall be the solvent surety, each for a like sum in the order passed in Crl.O.P.No31057 of 2019.

2. Heard Mr.C.S.Saravanan, learned counsel for the petitioner and M/s.Kirthika Kamal, learned Government Advocate for the respondent.

3. Order dated 27.11.2019, is modified to the extent that it is sufficient that the petitioner be released on executing a bond for a sum of Rs.25,000/-which the learned counsel states that the same has already been executed and one surety, namely parent and it is stated by the learned counsel for the petitioner that the parent has already executed the surety. The insistence of another surety, is removed and since the parent has executed the surety and the bond for a sum of Rs.25,000/- has been executed, the learned Judicial Magistrate - I, Erode, may hold that the execution of surety is sufficient and comply with the order granting bail.
