ORDER

The petitioner seeks for cancellation of Patta, standing in the name of the private respondents viz., respondents 4 to 7 for the property more fully disclosed in the affidavit filed in support of this Writ Petition.

According to the petitioner, during the pendency of the Civil Suit filed by the petitioner, the respondents 4 to 7 have illegally obtained Patta in their name, for the property more fully disclosed in the affidavit filed in support of this Writ Petition. The Civil Court judgment obtained by the petitioner in her favour has already been attained finality by the dismissal of the First Appeal filed by the private respondents. The petitioner had given representations to the official respondents, seeking for cancellation of Patta issued to the respondents

4 to 7 for the subject property. Since the said representations were not considered, the petitioner has filed the present Writ Petition.

3. Mr.S.Arumugam, the learned Government Advocate accepts notice on behalf of the respondents 1 to 3.

4. At the outset, the learned Government Advocate appearing for the official respondents would submit that the competent authority to consider the petitioner's representation seeking for cancellation of Patta is the Revenue Divisional Officer, Hosur Division.

5. Since the Revenue Divisional Officer, Hosur Division has not been arrayed as party respondent in this Writ Petition, this Court by exercising its power, suo motu impleads the Revenue Divisional Officer, Hosur Division as 8th respondent in this Writ Petition. Registry is directed to carry out necessary amendment in the cause title.

6. No prejudice will be caused to any of the respondents if the petitioner's representation is considered on merits and in accordance with law, after hearing the objections of the private respondents viz., respondents 4 to 7, within a time frame to be fixed by this Court.

7. This Court is not expressing any opinion on the merits of the petitioner's representation. Since no adverse order is passed as against the private respondents 4 to 7, notice to the respondents 4 to 7 is dispensed with.

8. For the foregoing reasons, this Court directs the newly impleaded 8th respondent to pass final orders, on merits and in accordance with law, on the petitioner's representations dated 29.08.2023 and 03.09.2024, seeking for cancellation of Patta, standing in the name of the private respondents 4 to7, for the property more fully disclosed in the affidavit filed in support of this Writ Petition, after hearing the objections of the respondents 4 to 7 and after due consideration of the supporting documents to be produced by the petitioner as well as the respondents 4 to 7, within a period of twelve weeks from the date of receipt of a copy of this order.
