No.699 of 2020 Prayer: Criminal Original Petition filed under Section 438 Cr.P.C., praying to grant Anticipatory bail to the petitioners, in the event of their arrest or on their appearance before any Court in connection with the case in Crime No.699 of 2020,on the file of the Respondent police.

ORDER

(The case has been heard through video conference) The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 342, 323, 506(2)IPC in Crime No.699 of 2020, on the file of the respondent police, seek anticipatory bail.

2. It is the case of the prosecution that the petitioners waylaid the defacto complainant Muruganantham and due to previous enmity, picked up a quarrel with him and thereafter attacked the defacto complainant with iron rod resulting in the defacto complainant sustaining injuries. Hence, the complaint.

3. The learned counsel appearing for the petitioners would submit that the petitioners are innocent persons and they have been falsely implicated in this case. Hence, he prays for grant of anticipatory bail.

4. The learned Additional Public Prosecutor appearing for the respondent submitted that the petitioners are notorious persons https://hcservices.ecourts.gov.in/hcservices/

and they have bad antecedents. Having engaged by other accused they have threatened and assaulted the defacto complainant, resulting in the defacto complainant sustaining injuries and hospitalisation. Hence, he opposed for the grant of anticipatory bail to the petitioners.

5.Taking into consideration the bad antecedent of the petitioners and they have also assaulted the defacto complainant resulting in the defacto complainant sustaining grevious injuries, this Court is not inclined to grant anticipatory bail to the petitioners.

6.With the above directions, this Criminal Original Petition stands dismissed.
