Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the respondents herein to name changed issue patta and measure the property of the petitioner in respect of survey No.186/5B Armbakkam Village and Post, Arakkonam Taluk, within the Sub Registration District of Ranipet and lay boundary for four sides and encroached be removed if any with the help of Police protection. ORDER

This writ petition has been filed to direct the official respondents to conduct survey and lay the boundary stones at the subject property.

2. Ms.Inthu Karunakaran, learned Government's counsel, takes notice on behalf of the respondents 1 to 4.

3. By consent of the parties, the main petition is taken up for disposal in the stage of admission itself.

The learned counsel for the petitioner would submit that in this case, a representation dated 28.01.2026 was filed by the petitioner before the respondents, requesting them to issue the name changed patta, pertaining to the subject property, in the name of the petitioner. However, the said representation was not at all considered by the respondent till date. Hence, this petition.

5. In reply, the learned Government's counsel for the respondent would submit that there is a legal dispute over the subject land and thus, the same has to be decided by an appropriate Civil Court. Hence, she prays for dismissal of this petition.

6. Heard the learned counsel appearing for the petitioner as well as the respondent and also perused the entire materials available on record.

7. In the case on hand, the petitioner and the 5th respondent had purchased the plots, measuring 40 cents of land, each. Now, the dispute between the parties is with regard to the title over the subject land at survey No.186/5B.

8. As rightly contended by the respondents, the title dispute over the subject property has to be decided by the Civil Court and hence, now, the right course available to the petitioner is to approach any appropriate Civil Court and agitate the matter accordingly.

9. In view of the above, this Court directs the petitioner to approach the Civil Court within a period of 3 months. In the meantime, both the petitioner and the 5th respondent are directed to maintain status quo.
