JUDGMENT

The accused in S.C.No.32 of 2008 on the file of the learned Additional District and Sessions Judge, (Fast Track Court No.III), Dharapuram, is the Appellant herein. By the judgment dated 19.5.2008, the Appellant was convicted for the offence under Section 332 I.P.C. and sentenced to undergo two years rigorous imprisonment and was convicted for the offence under Section 3(1) of the Tamil Nadu Public Property (Destruction and Loss) Act, 1992 and sentenced to undergo three years rigorous imprisonment and imposed a fine of Rs.1,500/-, in default, to undergo six months rigorous imprisonment and was convicted for the offence under Section 5 of the Tamil Nadu Public Property (Destruction and Loss) Act, 1992 and sentenced to undergo three years rigorous imprisonment and imposed a fine of Rs.1,500/-, in default, to undergo six months rigorous imprisonment. Aggrieved over the said conviction and sentence, the appellant has come up with the present appeal. https://hcservices.ecourts.gov.in/hcservices/

2. Today, when the matter was taken up for consideration, learned Additional Public Prosecutor submitted that the appellant had already undergone the entire period of sentence imposed on him, from 19.5.2008 till 26.8.2010 and he was released on 27.8.2010.

3. In view of the said submission made by the learned Additional Public Prosecutor, I am of the opinion, nothing survives in this appeal for adjudication and the appeal has become infructuous. Hence, the criminal appeal is dismissed as infructuous.
