JUDGMENT

(Judgment of the Court was delivered by M.M.SUNDRESH, J.) This writ appeal is directed against the order dated 28.06.2010 made in W.P.No.24643 of 2008, whereby the learned single Judge declined to grant the relief sought for by the appellant herein.

2.When the matter is taken up for hearing, Mr.S.Ayyathurai, learned counsel appearing for the appellant submits that subsequent to the order passed, certain developments have taken place. The final order passed by the respondent terminating the service of the appellant was put into challenge before the https://hcservices.ecourts.gov.in/hcservices/

Appellate Authority under the Shops and Establishment Act. The above appeal was allowed and the said order has become final. 3.In such view of the matter, nothing survives for adjudication in this appeal. Accordingly, the writ appeal stands dismissed as infructuous. However, insofar as subsistence allowance during the pendency of the proceedings is concerned, liberty is given to the appellant to approach the respondent. As and when such request is made, the same shall be considered by the respondent within a period of six weeks from the date of receipt of the said request. No costs. Consequently, connected miscellaneous petition is closed.
