No.328 of 2007, dated 08.07.2008 convicting the accused under section 147 IPC and 3(1) of the Public Property Destruction Act and sentencing him to undergo 2 years RI and to pay a fine of Rs.3,000/- in default to undergo 3 months SI.

JUDGMENT

The first accused is appellant in this case. The appeal has been filed against the order of conviction. Today, when the matter is taken up for hearing, the learned Additional Public Prosecutor appearing for the respondent submitted that pending appeal, the appellant/A1, namely, Pandian was died on 28.09.2017 and he has also produced a copy of the death certificate to that effect.

2. Since, the appellant/A-1 was died, the charges against the appellant/ A1 is abated. Hence, the Appeal is dismissed as abated. Consequently, connected miscellaneous petition is closed. The death certificate is form part of the record. https://hcservices.ecourts.gov.in/hcservices/
