This Writ Petition has been filed to direct the respondents to pay the monetary benefits for the period from 13.10.2006 to 28.06.2013 together with interest at the rate of 12% per annum pursuant to the petitioner representations' dated 30.07.2013, 29.03.2019 and 19.12.2023.
2. The petitioner joined the service of the third respondent in the year 1988 and was retired on account of superannuation on 21.05.2019. The petitioner claims that as per G.O.Ms.No.45, Personal and Administrative Reforms (Per-B) Department dated 15.02.1994, a new category of Typist
Grade-I was created to promote the persons who were working as Typist and had completed 18 years of service as Typist. Accordingly, the petitioner was upgraded to the new post called Typist Grade-I by proceedings dated 28.06.2013. The claim of the petitioner is that she had joined the service on 14.10.1988 and she had completed 18 years of service on 13.10.2006. However, she was upgraded to the post of Typist Grade-I only from 14.10.2006. The petitioner immediately made a representation to regularize her up-gradation from 13.10.2006 and to pay the consequential benefits for the period from 13.10.2006 to 28.06.2013. Since her representation has not been considered, she has filed the present writ petition.
3. Heard the learned counsel appearing for the petitioner, the learned Additional Government Pleader appearing for the first respondent and the learned Government Advocate appearing for the respondents 2 to 4.
4. The writ petition suffers from vice of latches as the petitioner had retired way back in the year 2019. We are now in the year 2025. Even as per the petitioner, she had sent a representation to the respondents on 30.07.2013
immediately after receiving the upgradation proceedings dated 28.06.2013. Thereafter, the petitioner has not chosen to pursue the respondents with respect to her claim and has approached this Court after a lapse of 11 years. On the sole ground of latches, this Writ Petition is dismissed. There shall be no order as to costs.
