ORDER
The petitioner who is an accused in Cr.No.259 of 2024 has filed this petition to quash the First Information Report. The petitioner contends that departmental proceedings were initiated against him and after a due enquiry, the Departmental Authority came to know that there was no illegality on the part of the petitioner. Consequently, his suspension order was revoked by the Regional Manager vide office proceedings in Na.Ka.No.E4/0001/dated 29.05.2025. It is further submitted that the petitioner arrayed as A3, was implicated in this case
based on the confession of A1 and A2. Furthermore, there is no seizure were made from the petitioner and no statements or records have been produced against him. Hence, the petition is filed.
2.The learned Additional Public Prosecutor strongly opposed the petitioner's contention and submitting that the petitioner is the Godown Superintendent at the Tamil Nadu Civil Supplies Corporation Godown, Vellore. It is alleged that during the petitioner's tenure, a shortage of 1600kgs of pulses and 1500kgs of rice was discovered. These PDS rice and cereals were subsequently seized from A1 and A2, leading to the petitioner's suspension on 02.01.2025. He further submitted that the petitioner was previously involved in a similar offence in Cr.No.284 of 2019 where the investigation is complete but the charge sheet is yet to be filed. Regarding revocation of the suspension order, it was clarified that the Civil Supplies CID, Vellore has completed the investigation in Cr.No.
259 of 2024 and filed a charge sheet before the learned Judicial Magistrate IV, Vellore. This filing was a primary consideration for the revocation of the suspension rather than a finding that there is no shortage of rice and cereals. Thus, the petitioner has not been absolved on merits. It was further submitted that due to some deficiency in final report, it will be rectified and resubmitted within a period of one month.
3.In view of the fact that the petitioner already involved in a previous case of a similar nature, and the fact that the investigation is complete, this Court finds that the revocation of the suspension was not on merits and the petitioner is not entitle for quashing of First Information Report in Crime No. 259 of 2024. Consequently, this Criminal original petition is dismissed and the connected Criminal Miscellaneous Petition is closed. 4.The trial Court is directed to take the charge sheet on file without delay upon its resubmission, assign a Calender case (CC) number and ensure that the trial is completed without any undue delay.
