This petition has been filed to condone the delay of 35 days in filing the Criminal Appeal.

2.Heard the learned counsel for the petitioner and the learned counsel appearing for the respondent. Though the learned counsel for the respondent sought time to file counter, till date, no counter has been filed.

3.Being satisfied with the reasons assigned in the affidavit filed along with the petition, this Court is inclined to allow the petition.

4.Accordingly, this petition is allowed and the delay is condoned.
