O R D E R

The wife in a matrimonial proceedings has filed the above transfer Civil Miscellaneous Petition seeking to withdraw H.M.O.P.No.2 of 2014 pending on the file of the Sub Court, Devakottai and transfer the same to the file of Sub Court, Poonamallee. The husband has filed the above H.M.O.P.No.2 of 2014 under Section 13 (1) (i-a) & (i-b) of the Hindu Marriage Act, before the Sub Court, Devakottai for divorce on the ground of cruelty.

2. Heard the learned counsel for the petitioner.

3. The services on the other side was not completed, but it is stated that the respondent had left. Today i.e. on 12.10.2017, when the matter was called, the learned counsel for the petitioner produced the copies of E-Court services, giving out the details of H.M.O.P.No.2 of 2014. From the same, it can be seen that H.M.O.P.No.2 of 2014 itself was disposed of on 29.10.2015, subsequent to the filing of the transfer petition. Hence, nothing survives in the transfer petition and the same has become infructuous.

4. In view of the same, this Transfer Civil Miscellaneous Petition is dismissed as infructuous. No Costs. Consequently, connected miscellaneous petition is closed.
