Rules, praying to pass judgment and decree against the defendant:- a) Directing the defendant to pay to the plaintiff a sum of Rs.1,02,00,000/- towards principal and a sum of Rs.5,10,000/- towards interest on the principal amount @ 12% pa. from August, 2013 to December, 2013 totaling in all a sum of Rs.1,07,10,000/-; b) To pay further interest on the principal amount @ 18% per annum from the date of plaint till the date of realization; and c) To pay costs of the suit.

J U D G M E N T

When the matter is taken up for hearing today (18.09.2018), the learned counsel appearing for the plaintiff seeks permission of this Court to withdraw the present suit. To that effect, he has also made an endorsement to that effect.

2. In view of the submission and the endorsement made by the learned counsel appearing for the plaintiff, this Civil Suit is dismissed as withdrawn. There shall be no order as to costs. Consequently, connected application is also closed.

3. Registry is directed to refund the Court fee, if it is permissible, as per Rules. 18.09.2018 asi Note: Registry is directed to return the original documents to the plaintiff.
