and quash the same and direct the respondents to promote the petitioner has office Superintendent in the Backlog vacancy Scheduled Tribe (ST) with effect from the date of Promotion to the post of Assistant Superintendent in the Light of Brochure on Reservation for SC St and Other Backward classes under Chapter 6 and filling up of Reserved vacancies under the Sub Heading 6.12 Promotion by non selection and in the light of Department of personnel and training OM No 22011/1/90 ESTT (d) dated 12.10.1990 and also in the light CF the promotion granted to the General Category Employee by waiving the requirement of 2 years qualifying service with all service and monetary benefits.

ORDER
Heard the learned counsel for the petitioner and the learned Standing Counsel appearing on behalf of the respondents and perused the material papers placed on record.
2. The petitioner in the present Writ Petition has assailed the action of the respondents for not granting promotion and rejecting the claim of the petitioner vide proceedings therein No.A2/385/2015/T dated 06.03.2021 2/6
with a consequential direction to the respondents to promote the petitioner to the post of Office Superintendent in the backlog vacancy reserved for Scheduled Tribe.

However, when the Writ Petition is taken up for hearing today, the learned Standing counsel appearing on behalf of the respondents submitted that during the pendency of the present Writ Petition, the Authorities have taken up verification of genuineness of the community certificate of the petitioner and having found that the community certificate is not genuine, the Authorities initiated disciplinary action and cancelled the appointment of the petitioner vide proceedings bearing No.A1/370/2024/T dated 12.06.2024.
4. The learned Standing Counsel appearing on behalf of the respondents further submits that, the petitioner aggrieved by the aforesaid order / disciplinary action in cancelling her appointment, had approached this Court by filing a separate petition in W.P.No.17204 of 2024.
5. The learned Standing counsel further submits that the petitioner was unsuccessful in getting any interim order in the aforesaid writ Petition and the said Writ Petition is pending consideration on the file of this Court. 3/6

The learned Standing counsel appearing on behalf of the respondents thus, submitted that the cause of action in the present Writ Petition does not survive for consideration in view of the subsequent development and as the petitioner's appointment has been cancelled, nothing survives for further adjudication.
7. The learned counsel for the petitioner is not aware of the subsequent development of the petitioner's appointment itself being cancelled by the respondents and the petitioner has approached this Court by filing a separate Writ Petition assailing the same.
8. The learned counsel for the petitioner however fairly submits that this Court may place on record the aforesaid statements of the learned Standing Counsel appearing on behalf of the respondents and close the Writ Petition as infructuous.

In view of the aforesaid submissions made on behalf of the parties and since, it is now informed to this Court that the petitioner's appointment having been cancelled and the petitioner having challenged the same, which is the subject matter in another Writ Petition, this Court is of the view that 4/6
since, the appointment of the petitioner having been cancelled, the cause of action in the present Writ Petition does not survive for consideration and hence, the Writ Petition is closed as infructuous. There shall be no order as to costs.
