Mr.K.Arunprasad Order The Writ Petition is filed by the petitioner challenging the impugned order of the 2nd respondent, dated 19.02.2026, whereby the petitioner's bid was rejected and consequently direct the Respondent not to disqualify the petitioners by citing ''poor vendor rating'' for all future contracts.
2. Case of the petitioner is that the petitioner Company have been undertaking contracts by way of tender from the respondent Corporation for almost three decades. The 2nd respondent had published a tender in December 2025 calling for the work of sand blasting cleaning and painting of trash rack panels of unit 12 at Bhavani Kattalai Barrage power House 1, Samayasangili, dated 30.12.2025. The petitioner had participated in the tender and submitted their bids. However, the petitioner's bid had been rejected citing ''poor vendor rating'' and the tender has been awarded to a third party. Aggrieved by the rejection, the petitioner is before this Court.
3. The learned counsel appearing for the petitioner would submit that though the petitioner made representation to the 1st respondent stating all the difficulties which faced when the last work order was issued by the respondent
and enclosed all the medical reports which would show that after the work order was issued on 22.04.2022, the petitioner suffered from ''Coronary Neuro Ailment'', the respondent had rejected the petitioners' bid citing ''poor vending rating''.
4. The learned counsel appearing for the respondents would submit that as against the rejection order, appeal remedy is available under Section 11 of the Tamil Nadu Transparency in Tenders Act, 1998. The petitioner without availing the appeal remedy, approaching this Court by filing this writ petition, is not sustainable and prays for dismissal of this petition.
5. In response to the said submission, learned counsel for the petitioner would submit that this Court may direct the respondents not to disqualify the petitioners by citing poor vendor rating for all future contracts.
5. Heard the learned counsel appearing for the petitioner and learned counsel appearing for the respondents.

In view of the limited request made by the learned counsel appearing for the petitioner and this Court, without going into the merits of the case, permits the petitioner to file a fresh application before the appellate authority within a period of two weeks from the date of receipt of a copy of this order and
the period pending before this Court in the writ petition, is excluded for the purpose of limitation and if any application is filed, the appellate authority is directed to consider the same and pass orders on merits within a further period of six weeks thereafter.
7. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs. Consequently connected miscellaneous petition is closed.
