ORDER
The writ petition is filed for the below relief: "calling for the records in connection with the Charge Memo No.DC1/12900/2022-5 dated 25.11.2022 on the file of the Respondent and quash the same.".
2. The brief facts which are culminated in the filing of this writ petition are set out below:
2.1. It is the case of the petitioner that the petitioner was working as Field Assistant. While so, on 25.11.2022, a charge memo was issued to the petitioner along with a questionnaire for issue of fraudulent Sale Deed to the bogus allottees which caused huge revenue loss to Board. Since the charge is absolutely baseless and groundless, the petitioner is before this Court.
3. Heard the learned Counsel on either side and perused the materials available on records.
4. The petitioner seeks to challenge the charge memo on the ground that there is no clarity in the charge memo as the allegations are vague and devoid of material particulars. It is also the case of the petitioner that he is only a Field Assistant which is only a ministerial duty and therefore, he cannot be linked into the issue.
5.However, reading of the statement of the charges does not show any ambiguity as alleged by the petitioner. Further, the petitioner has also submitted the detailed written statement to the charges which goes to show that he has fully comprehended the charge and responded to them. The said written
statement to the charges was submitted by the petitioner as early as on 21.12.2022, whereas, the petitioner has approached this Court four years thereafter. In the light of these facts, I see no reason to quash the charge memo impugned in this case. However, the respondents are directed to conclude the enquiry proceedings before the month of June 2026. Accordingly, this writ petition stands dismissed. Consequently, connected miscellaneous petitions are closed.
