Civil Suit is filed under order IV Rule 1 of O.S Rules read with order VII Rule 1 CPC praying for the following relief:-
1. For specific performance directing the defendant to execute the sale deed of the suit schedule property in favour of the plaintiff as per the terms of the suit agreement dated 24.11.2007 and put the plaintiff in possession thereof, failing which this Court may be pleased to execute the sale deed of the suit schedule property in favour of the plaintiff.
2. directing the defendants to pay the costs of the suit. For Appellant :

3. In view of the submission made by the learned counsel appearing for the appellant, the original side appeal stands dismissed as settled out of Court. The appellant is entitled to refund of entire court fee. No costs. Consequently, connected miscellaneous petition is closed.
