A.No.1986 of 2022 has been filed to bring on record Mrs.Raziq Ali; Mrs.Mohamed Nusrath Shifa and Mrs.Ahamed Sabrin Himaya, who are remaining legal heirs of A.P.M.Mohammed Hussain Abdul Khader (D4) as defendants 12 to 14 in CS.No.880 of 1999 and recognized M.H.Mohamed Junniah Fathima the 10th defendant and Halith Sultan the 11th defendant as legal heirs of the deceased 4th defendant.

A.No.3515 of 2022 has been filed to condone the delay of 1333 days in filing setting aside the abatement to implead the remaining legal heirs of deceased 4th defendant.

A.No.3518 of 2022 has been filed to set aside the abatement in impleading the remaining legal heirs of deceased 4th defendant.

2. Heard both sides.

3. The learned counsel for the respondents has no serious objection in allowing these applications.

4. Considering the facts and circumstances of the case and in view of no serious objection submitted by the learned counsel for the respondents, this https://www.mhc.tn.gov.in/judis

gv Court is inclined to allow these applications on payment of cost of Rs.2000/- payable to the respondent.

5. The learned counsel for the applicant has paid a cost of Rs.2000/- (Rupees Two Thousand only) directly to the learned counsel for the respondent and the learned counsel for the respondent has also made an endorsement to that effect.

6. Accordingly, these applications are allowed.

7. Post the main case before this court on 20.09.2022 to carry out the amendment.
