O R D E R

[Order of the Court was made by C.T.SELVAM, J.] Challenge is made to the order of detention passed by the third respondent vide Proceedings in No.03/DM/RO/D2/PPASAA/2018 dated 24.04.2018, whereby the

detenu, by name, Soosairaj @ Soosai, son of Joseph, aged about 29 years, was ordered to be detained under Sub Section (2) of Section 3 of the Puducherry Prevention of Anti-Social Activities Act, 2008 (Act No.10 of 2010) branding him as a "DANGEROUS PERSON".

The detention order has been passed by third respondent in No.03/DM/RO/D2/PPASAA/2018.

3. We have heard learned counsel for petitioner and learned Public Prosecutor as also perused the records.

4. Learned Public Prosecutor (Puducherry) would submit that the order of detention dated 24.04.2018 has not been confirmed in keeping with Section 3(3) of The Puducherry Prevention of Anti-Social Activities Act, 2008.

5. This Court is of the view that the detention order is unsustainable in law on the ground of inordinate and unexplained delay of 2 days in passing the detention order and the same is liable to be set aside.

6. Accordingly, the Habeas Corpus Petition is allowed and the impugned detention order is set aside. The detenu is directed to be released forthwith unless his presence is required in connection with any other case.
